General Terms and Conditions

Scope
These General Terms and Conditions (hereinafter “GTC”) apply to all services offered by Paw & Property KlG (hereinafter “P&P”) for the website www.maisonBo.ch and their brand maisonBo in Switzerland. By using the services of P&P you (hereinafter “customer”) accept the following terms and conditions unchanged and in full. Applicable is the current version of the GTC, which is published at the time of the conclusion of the contract. Amendments to the contract, subsidiary agreements as well as conditions of the customer shall only become part of the contract after written acknowledgement by P&P.
Data protection and copyright
The customer hereby agrees that P&P is permitted to use the personal information provided by the customer. The Privacy Policy forms the basis for the corresponding use of the personal information and is an integral part of these GTC.
All content provided by P&P is protected by copyright.
Online Shop
3.1 Service area and offer
P&P delivers its products under the name maisonBo throughout Switzerland. Accessories, decoration and the like shown in the product images are not part of the offer, unless expressly included therein. Minor deviations in terms of color, processing and structure to the products shown in the online store are reserved.
3.2 Conclusion of the contract
When purchasing or ordering P&P’s products in the online store, the customer makes a legally binding offer to conclude a contract by accepting the GTC and data protection provisions and then sending the order. P&P confirms the receipt of the order by e-mail after receipt of the order. Only with this confirmation the contract is considered as concluded. The conclusion of the contract is subject to the availability of the ordered products. The goods remain the property of P&P until full payment has been received. If the ordered product is not available, P&P will inform the customer.
3.3 Payment methods
P&P offers various payment options in the online store.
3.4 Delivery
Deliveries are made with the Swiss Post or another parcel delivery service. Delivery times are shown at check-out and are mere estimates. P&P is not liable for any delays in delivery and/or for any damages incurred in this regard.
3.5 Inspection of the goods / notice of defects
Customers shall check the goods for completeness and intactness immediately upon receipt. Defects discovered at a later time must be reported to P&P immediately after discovery. P&P reserves the right to remedy defects. Only if this is not possible, a new product will be sent to the customer or a refund will be granted. Non-defective goods are excluded from exchange or refund.
Prices
According to article 10 paragraph 2 letter a MWSTG P&P is not liable for VAT. All prices quoted in CHF are therefore exclusive of VAT, inclusive of other statutory charges, but – unless expressly stated otherwise – exclusive of delivery and assembly costs.

Final provisions
6.1 Swiss law shall apply exclusively, to the exclusion of the conflict of laws provisions and the provisions of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Basel.
6.2 The customer may only set off claims against P&P that have been legally established and are not disputed.
6.3 P&P reserves the right to change these GTC at any time. Changes will be made available on the website and come into force when they are posted.
6.4 Should one or more provisions of these GTC be or become invalid or unenforceable in whole or in part, the validity or enforceability of the remaining provisions of these GTC shall not be affected thereby. In this case, the parties shall replace the invalid or unenforceable provision with a valid and enforceable provision that comes as close as possible to the economic purpose of the provision to be replaced. The same shall apply mutatis mutandis in the event that these GTC should contain a regulatory gap.
6.5 If the English version of the GTC differs from the German version of the GTC, the German version shall apply.
